Question Hi, I have a situation where my ex-wife's brother is threatening to place a lien against my home for personal property that he states was stolen from him when he went to federal prison on drug charges. My ex and I have not been together for over 5 years and we have been divorced about 3 1/2 years. His claims are ridiculous as we don't have very much to do with one another. The money he had when he was booked into jail was released and signed for by my ex, and presumably she picked up all his personal property from his residence. These are the items he is claiming were stolen. I have a two part question. 1. Can a lien be placed on my property arbitrarily or in the unlikely event he sued me and was awarded a judgment? (I didn't think Texas was a state where you could do that.) 2. I was 'awarded' the home in the divorce decree but have not refinanced or performed a quit claim deed to remove her from the deed. Would a quit claim deed damage my ability to get title insurance in the future? And is it a recommended course of action in a divorce situation in Texas?
Answer Hello,
I believe you should contact a title company. However, I do not believe he can place a lien with out a judges abstract. I also do not believe you need to do a quit claim deed if you have a good divorce decree. Gretchen with Land America title company can help you with all this. Her number is 817-552-3900.
