Subject: Selling of Heir Property

Question
My mother is selling heir property that is only in her name only via an affidavit of heirship.  Does she have to give any money from the sell of the property to her brother.  His name is not listed on the property at all.  Is she entitled to give him anything from the sell of their parents property.  There was no will left from either parent.  My mother was named Executive of the Estate and that was all.

Answer
It sounds like you might have some circumstances that make this not a clear cut issue.  If I were you I would contact an attorney if I was in doubt.  They can give you the guidance you need to help you though this, should that be the case. Thanks for writing and I wish you the best of luck.
