Expert: Donald J. Leske II - 11/4/2009
Question Hello: I have requested contact information (tel. number or email) from my Property Manager, so that I might personally express to my new tenant my apologies that the stove does not work and what is being done, etc. Property Mgr. has refused and says she needs permission from tenant to give out personal information. I say I am entitled to a copy of tenants application and rental agreement. Who is correct? I am an out of state owner (California), they are in Boise, ID.
thank-you
Answer Hello,
I am not a real estate lawyer.., but it is my understanding that the owner is entitled to such information if they want it. It is not a secret. A Property Manager is prohibited from giving out a tenants private info such as SSN, date of birth and copies of their Credit Reports. We do NOT like to give out contact information as a rule, only because once the owner contacts a tenant we have learned the hard way that tenants will then communicate with the owner about issues and problems.... not the Landlord.
The Landlord looses control, the tenants laugh at him and just go to the owner. Owners end up mad and blame the Landlord for this, sometimes the owners fire the Landlord and just collect the rent themselves.
I hope this has helped,
-Don
