Retail Property Management - rental issues

Expert: Mike Fortunato - 5/28/2009

Question
I was evicted from a property that I ended up suing. The rental company admitted to misplacing funds that I paid for rent in a different account and subsequently charging me for non-payment and late fees. The company gave all tenants a packet stating that they would refund rent for a day each day they were not happy but they refused to honor it. In court, the property manager stated that no eviction or proceedings ever took place however, there were 3 consecutive months of eviction notices, 2 with warrants of repossesion. At the time of trial, this case was forwarded to a collection's agent. Is the company entitled to both or do they have to sue to get what is owed? I am suing to get what I feel I am owed

Answer
Sorry, but your question is far too involved in legal issues for me to be able to understand completely. This is something an attorney would need to answer so that you get a correct and accurate read. Note that an attorney, before rendering an opinion, would probably need to know more details about the situation than what is provided in your question. My best guess is that this will all be sorted out in court, if not settled before then by your respective lawyers. Best of luck.
