Question
QUESTION: "My house was just re-roofed (tear-off)with Timberline high definition prestique 30 shingles, charcoal.  I noticed we were not  getting high definition affect so I measured many courses and found the shingle offset was not being closely adhered to required by manufacturers instructions for application. For example some shingles were off spec by 3or 4 inches and as much as 8 inches.
What are the consequences of not following manufacturers application instructions with these shingles.  Besides appearance issues will leaks occur in the future. What are acceptable offset tolerances for these shingles. What recourse do I have.  I believe the roof should be re-done-am refusing to pay balance due. Thanks



ANSWER: Oh wow! I feel your pain on this one....it seem like you are a consumer, who compares based on QUALITY and performance, by your selection of the GAF-ELK Timberline 30 year high def shingle.

I have not seen your roof, but can picture it based on your description. You are with-in your right to hold the payment, until you receive assurance that you are receiving what you contracted for.

Also, may I recommend that you do the following:

Ask the roofer where he bought the shingles from...contact THAT supplier, and ask for the LOCAL GAF-ELK rep cell phone number. Call him directly, and ask him to visit your home, to review the roofing thus far, and to get his opinion of IF, the roof will have the manufacturers warranty and protections with the way it is installed. IF he passes the roof and says you are covered, the your worries are moot and you can pay off the roofer. But if the rep has suggestions, at least you will know how to proceed, in a LEGAL and REASONABLE manner, that your contractor cannot argue with you over!

QUESTION: Thanks for your response which is  already in the works--I spoke to a Tech at Gaf today who told me not following offsets as set out in application instructions not only affects appearance but also will lead to leaks--it is considered a misapplication canceling certain aspects of the warranty--I can't wait to see what the rep says. Thanks again

Oh man,...sorry for you......good luck with it all...listen, protect yourself a little further...it seems like you have made a partial payment for the deal thus far....I am not sure what your state law is in regards to LIEN rights. In OHIO, where I operate my company, Rooftime, the SUPPLIER holds a MATERIAL lien right on the address where the shingles are installed, and not on the roofer! SO if the roofer defaults on paying for the material, the supplier may try to place a LIEN on your home! Even if you can show that you already paid the roofer, the law here, says you MUST pay the material and then YOU have to go sue the roofer! Please check this out for your state, and demand that your roofer provide you with a notarize WAIVER of MATERIAL LIEN right away!. Even if he makes on up fraudulently,you would still be protected legally down the road....not saying you will have issues later, but just wanted you to be sure!
