Small Business/Contracts Law/advertising agreement with L.A. Times

Question
Hello,

L.A. Times is trying to collect over $10k from me for advertising services that were not even rendered based on a contract agreement to advertise with them every week for a set amount.  The problem is, I closed my store, so I had no need for their advertising services.  But their attorneys are saying that I have other businesses, and therefore I am still liable to them for advertising.  Can you please help before the L.A. Time's bulldogs get me. I know you can't give me legal advice but maybe you can guide me in finding the answers myself.  Thank you.

Answer
For that amount, you probably do need to seek the assistance of an attorney, although, if the LA Times' interpretation of its contract is correct, you still may lose the case.  For a defensive action, you will likely need to pay by the hour.  The other alternative, which I assume is not practical, is to follow their suggestion and use the advertising elsewhere.  Or inquire as to whether you can resell the advertising or negotiate to place only $7000 or so worth of advertising (modifying the contract).

To find an attorney to assist you, I would recommend asking some businessmen friends or the LA County Bar Assn. referral service:  http://lris.lacba.org/vlris/index.cfm

I hope this helps.  Best regards,
