Experience I have been an education advocate representing students and parents for six years. My experience includes: representing my clients in IEPs, SSTs, Due Process, review assessment results for my clients, and mediations. I have represented clients with learning disabilities, autism, Downs Syndrome, cognitively challenged, emotional problems, learning disabilities, ADD/ADHD, and physical disabilities. I have also represented clients to County Mental Health Departments and Regional Centers. My clients range from pre-school to college students in many states.
Education/Credentials I have a degree in Mathematics from the University of California with minors in Psychology and Physics. I also studied applied statistics in psychology at the graduate level. I have taught college classes, conducted seminars, written articles for various publications, and testified as an expert witness.

Question We had IEP for hearing impaired daughter in May last year. District could not offer more than twice a week speech therapy for our child so they contracted with outside agency to pick up another day. District now wants to call another IEP because they can offer a third day and cut agency. It is November. We feel original IEP meets our child's needs and child has relationship with both SLPs. Is there any way we can keep original IEP and not have district on the third day? Sounds crazy, we know, but third day SLP is from oral deaf school-much more specialized to our child's needs. In additions we are concerned about consistency from district (District SLP is out for IEPs, meetings, jury duty, illness, etc and there is no make up day offered-child just misses session). But IEP is written as "so many sessions yearly." How can we keep current IEP schedule?

Answer You should attend the new IEP because the district has the right to call one. At this IEP, explain why you want to keep things the way they are. Make sure your arguments are included in the IEP Notes. Also make an audio recording of the IEP (you must notify them one day in advance that you are going to make a recording). If the district insists on changing the services to their in-house person, you have the option to sign the IEP but to not agree to changing the current services. The law says you have this right and that the District can not change services without your signature agreeing to the change. The district does have the option to file for Due Process against you, but this is costly for them. If they file, you can try to work things out at a resolution conference or mediation before having to go to hearing.
