About Justin Gerstein
Expertise
I have been studying the Court for some time. I consider myself to be a liberal; so my opinions of the Court seem to allign themselves with the liberals on the Court. I have studied in-depthly the Warren, Berger and current court.

Experience
I have read much on the Court and its history. I have read recent trends and issues that the Court has delt with and will deal with. THe history of the Justices is one area where I have read much. I consider myself to be a liberal and I enjoy reading the various cases that the Court released. I read US Suprmem Court cases the most.

Supreme Court Cases - Scope of Supreme Court rulings

Expert: Justin Gerstein - 12/7/2002

Question
Can / Will the Supreme Court hear a case that has been tried in state courts?  This particular case has already been heard and decided upon at the State Supreme Court level.

Thanks!

Answer
Hi Bill,
If the case has been appealed all the way to the Supreme Court and the Court agrees to hear then they will hear it, but there will be no Jury.
However most times the Supreme Court if it sees a trend in cases will combine it with other cases of similar magintude.  That is the most likely senario.
But the appeals process is relavitvely simple:
First it goes to the Highest State Court, then to the Federal Court of Appeals then to the Supreme Court...it is a long process.
I hope this helps.
JG
