Question Well recently I received a series of postal money orders and took them to my post office to check if they were good and the clerk took them back and examined them and stamped them with their stamp assuring me they were valid. Problem is, after I took them to my bank and cashed them in good faith the postal service had done their job, they turned out to be counterfeit. I contacted the postal inspector and he said that the postal service could not take responsibilty for their mistake. I find it hard to beleive that they could be that negligent to stamp counterfeit documents as valid. The way I found out they were fake was I called another post office and gave them the serial number and they told me right away there was no record of that document being printed. How could this happen? Am I supposed to take financial responsibilty for their mistake? This is extremely upsetting and I will not stand idly by and get screwed.

Hello sir, I apologize if my question does not fall within your expertise, however there doesn't seem to be a category for such a subject yet. My question is, can I take any legal action against the United States Postal Service for negligence leading to financial losses of $3,400 in Arizona small claims court? Or what other legal options do I have in such a case?
Answer -
what happened exactly?
Answer The person who caused your the lose was not the post office but the person who gave you the fake money orders. A criminal complaint should be filed against that person. The postmaster is correct that the mistake is regretable but they are not responciable for human error by a clerk. You should file a complaint with your local police and the postal inspectors about the person who gave you the money orders.
Its extremely unlikily your going to get your money back
unless the criminal court orders restitution by the person who gave you the money orders.
If you try to sue the post office in this matter it will be quickly dismissed by the court. You do not have a case against the post office.
