Expert: Mike Wellman Date: 1/30/2008 Subject: 1099 Misc wrong
Question I received a 1099 Misc form and in box 7 the amount is way more than I actually received. The only problem is that the guy paid me in cash and I never got a receipt. While I have no way of proving what he paid me, he had no way of proving that is what he paid me either. What can be done?
Answer Report what he actually paid you. In about a year, you may receive a letter from the IRS asking about the discrepancy and proposing to increase your tax liability. Write a letter back stating that you were not paid that much. At that point, the burden of proof is on HIM to prove he paid what is on the 1099. You win.
