Question Hello,
I started my current job on August 28, 2005. Before i started, the office manager had me fill out a w-4 as a part of the hiring process. Every year since then I have received a W-2. Now that we have a new office manager things are going a little crazy. She does not know what she is doing and is trying to make me and my fellow employees pay for it! She claims that she worked for a CPA, but she doesn't know how to work Quickbooks! She was hired in late August last year and is now telling us that no taxes were taken out of our checks last year, so she is not going to make us a w-2 because she does not want my boss to get in trouble. What I took home last year was a little more than the previous year, but I was told by my boss that income taxes were being taken out and it was all being handled by a local CPA. I was told that my take home pay was my net pay, not my gross pay. I have been asking for a check stub since I got this job and I have never, ever received one! I was really looking forward to filing my income taxes this year, but now what do I do? I was told that it was all being handled only to find out that it probably was not. And now knowing this, I am wondering if the past years were even taken out, even though I did get a w-2 for 2005 and 2006 from my employer. I am at my wits end and am really worried about getting into trouble with the IRS. What do I do? Will I owe the IRS any money even though it was not my fault?
Answer First, you will not get in trouble but you may end up owing tax and your half of social security. You need to complete IRS Form SS-8. That will cause the IRS to make a determination as to your status as an employee.
If you received a W-2 in prior years - you do not have to worry about those. You should tell the office manager that you are going to complete Form SS-8 if you do not receive a W-2 for 2007.
