Subject: Foreign Income Tax Exclusion

Question
If I were to work in Iraq from April 09 - April 10 as a U.S. contractor in support of the military would I be eligible for the Foreign Income Tax Exclusion? Also how would it work during the two seperate tax years? How and when would I file my 09 taxes?

Answer
For you to qualify for the full exclusion of $87,600 for 2008 you need to have lived in the foreign country for 330 consecutive days in any tax year.  You will receive a proration of the exclusion for 2008.  Your taxes are due April 15th 2009 for your 2008 taxes, which may be extended to October 15th 2009.
