Expert: John L. Tidwell

Subject: filing married/single

Question
I am trying to get back child support from my daughter's mother, out of she and her boyfriends taxes. They have been filing married, although not married. She doesn't work. Will they be able to get around me getting my money out of their taxes? Once you claim married can you just go back to filing single?

Answer
William:

If she is not working, then, she is not paying any taxes.  Since, he is not responsible for the child support his taxes are exempt from being captured for child support.  He can file married but filing separate return.  Almost the same as filing single.

John
