Question I am not a US citizen and not a us resident. I am from Argentina and I have an online business working from Argentina. I will like to offer my service in the USA, too. How can I apply for a LLC?. Do I have to pay taxes? In which state do i have to apply?. In a feew weeks i will be doing business for 3 months in NJ. I have to apply there?. Regards,

Thank you for your question.
You can incorporate in any State of the United States. If you do business in New Jersey, you will just have to file a tax return to report that income to New Jersey. You also may be required to file a New Jersey Non Resident income tax return, picking up your share of gain or loss.
Usually people incorporate in a state where there is no tax liability.
If you set up an LLC it is similar to a partnership. You would file as a Non Resident Alien and report your share of the earnings to the state once a year.
1)How can I apply for a LLC?. Find a lawyer in the US that can incorporate you. They have services on line that can expedite this process for you.
2) Depending on the state would determine whether the LLC pays a tax or not. Usually the gain or loss will pass through to the individual. You would file a 1040 NR and pay the tax once a year. You would also file a Form 1065 for the Federal LLC. The State part of the LLC depends on which state you incorporate.
I can look this up and make some recommendations. Off the top of my head, the states to incorporate where there is no state tax is Texas
and Nevada.
