Subject: Personal use of company vehicle
Question I have a company car and need to log my business v. personal miles. How do I determine personal use? I have a regular office, and I realize that commuting to and from the office is all considered personal use. However, I am a lawyer, and let's say I have an arbitration to attend somewhere else in the city, and I drive to that arbitration straight from home. Can I count the entire mileage to and from the arbitration as business miles? Would this analysis change if I did not have a regular office? Thanks for your help.
Answer Your first trip from home to where ever is commuting (personal) and not deductible unless you have a qualified office in home. If you think you do, you want to read the Soliman case (or Solimen). If you do not have an office in home, you would be much better off stopping in the office to check messages so that your mileage to where ever is deductible.
