Subject: Sole Proprietorship, TX, Divorce
Question My wife has had a sole proprietorship in TX for aproximately 8 years. we are
divorcing, for primarily financial reasons and previous years tax returns have
yielded small tax refunds or slight payments to IRS. As the divorce is being
filed all of a sudden, she says "we" owe 32K!! I think somethings up. She says
it's "our debt". I have a corporate job where taxes are withheld bi-weekly and
have been providing my earnings statement to her and her bookkeeper. The
accountant has been very slow at providing information to me about our tax
obligations/refunds. Is she, my soon to be ex-wife, going for the throat
here? Appreciate your assistance
Answer Hi Kelvin it might be that the 32 k results from filing separately
suggest to her that the divorce decree become effective after Jan1.2009 so that in 2008 you would still file a joint return you may be being grabbed somewhere lower than the throat you may need to ask for certified statement for the 2008 year
