Subject: 501(c)6 Corporation

Question
My Chamber of Commerce is trying to figure out if we are allowed to make charitable contributions using member funds or if this will affect our non-taxable status. Can you answer that question for us? Although I don't believe it makes a difference, we are in Maryland.

Charlotte

Answer
The donations are allowed provided that the donation is permitted under the Articles of Organization of the Chamber of Commerce.

The charter or Articles must provide the language that permits donations to be made from member funds.  If your Articles or Charter is silent on making donations to charitable organizations, than it is best not to do that.  Get the Articles or Charter changed to reflect that action.
