Subject: Non-For profit federal income tax
Question Dear John Kirk,
I'm the secretary for a non-for-profit club on Long Island, NY. Let me give you a little background about the club.
1- To promote the interest and provide a place for people interested in Portuguese culture to meet.
2- The club is a members only club (all members pay small annual dues)
3 -The corporation pays state quarterly sales taxes.
4 -The board that oversees all operations is formed by volunteers that donate there time like myself.
5- the club organizes parties to benefit cancer victims.
My question: I was appointed in the beginning of the year by the members; i want to do what is right and want to make sure the organization is following the law. I have asked if the club files federal taxes but nobody including past Directors know. I can't find any copies that show we do.
How do i find out if we are federal tax exempt and if we are a 501(c)(3) or 501(c)(4) non for profit.
Answer You should have articles of incorporation and Bylaws that were drafted by an attorney. The attorney's name should be included among the papers, contact him to see whether the club received a tax determination letter. You would not be required to file a tax return if the receipts were less than $25,000.
