Question IN THE CASE WHERE A CUSTODIAL PARENT HAS NOT WORKED THAT TAX YEAR AND THE NON-CUSTODIAL PARENT HAS. WHO HAS THE RIGHT TO CLAIM THE CHILD FOR TAXES? THE NON-CUSTODIAL PARENT, OR THE CUSTODIAL PARENT AND STEP-PARENT?
IN OTHER WORDS, DOES THE NON-CUSTODIAL PARENT HAVE THE RIGHT TO DENY THE STEP-PARENT FROM CLAIMING THE CHILD SINCE THE CUSTODIAL PARENT DID NOT WORK?

The custodial parent is the parent that can claim the child no matter what, unless the custodial parent releases the exemption with the proper form.
