Question
I am going through a divorce, in that process I have found out that my wife (who had handled all the finances) has not filed our taxes since 2004.I have requested several times for copies of the tax returns from 2000 to 2003 when she did file, and copies of our paper work. I have also contacted her attorney. I have had no response from either of them. I sought out a tax professional who said I need to protect myself. I filed taxes for the years my spouse didnt I used all of our children as an exemption,I am getting a refund, do I legally have to give her half of that refund?

Answer
As a married couple filing separately dependent deductions are negotiated between the spouses. If you were divorced your divorce decree should determine it.

All in all it is one of the points that can be negotiated. If she doesn't think to bring it up, I doubt her attorney will be savvy enough to think of it.
