Tax Law (Questions About Taxes) - rental loss

Expert: Helen P. O`Planick, EA - 10/18/2009

Question
I live in Wisconsin but rented own home in Pennsylvania to my son and his family. They have fallen on hard times and have not been able to pay their rent. Can I claim the rent I have not received as a captial loss, or is there another way cover this loss on the Tax Return?

Answer
Sorry, but no.  If you did not receive the rent, you do not claim it.  You can still take expenses as long as you are charging your son what you would charge me for the rental.

If not, your loss is whatever it is or -0-, but no lower than -0-.

Helen, EA in PA
