Tax Law (Questions About Taxes) - Disability Income and FICA Tax

Expert: John Stancil, CPA - 11/6/2009

Question
In a previous answer, you stated that disability income is not subject to FICA. That does not seem to be what the disability insurance company says, but I cannot find it referenced in the tax code.

Answer
I can't speak for the insurance company, but my wife is on disability, I have done numerous returns that included disability income and none of them have ever paid FICA tax.  I don't have a citation for you, but FICA is levied on earned income, disability income is not earned income.
