Question
Hi Glenn,
My fiance works for himself and has not filed his income taxes in 2 or 3 years.  This is preventing us from moving out of my parents home because he cannot provide proof of income.  Its also preventing me from marrying him because I don't want his lack of responsibility effecting my taxes.  What should he do about this and what, if any consequences does he face?

If he does not file and has income to report, then the IRS can treat him as a non filer and file on his behalf based upon information he has. If they compute a tax owed, then he will owe tax , penalty and interest. They can then follow a process to search for assets and attach liens on assets such as bank accounts, etc..They will then notify the state and they may search by  liening and if they compute refunds, the state could lein those refunds.

He should sit down with a tax professional, order IRS transcripts of his income for all those years which was reported to IRS and file. Then he can gather all his returns and have the preparer prepare an offer in compromise and settle with IRS and then settle work with the state on settling.

If he had W-2 in those years, he may have to contact prior employees to get a copy of his W-2 or call up the state and get state withholdings he had on those W-2's.

Its a project, I have done alot them, but it can clear up alot of the past so you can move forward.
You can then get married, arrange to move out of your parents house, and start to lead of life of productive people who want to contribute to society.
