Question Dr. Stancil, In 2008 we finalized an adoption. We began the process in 2007 (spent $8000) looking at one child which ended when the agency had problems. We started again with a new agency in 2008 (spent $25000) and were successful in adopting a different child. My Question? Can we take a tax credit (Form 8839) in 2007 for what we spent and another tax credit in 2008? Or are we limited to one tax credit? Also, we had some additional adoption expenses in 2009, is there deduction available for these 2009 expenses?

The credit is limited to $11,650 for 2008. Since it is a foreign adoption, you can only deduct expenses in the year in which the adoption became final. This it is total amount for each adoption, not for each year.
This means you get no credit for the $8,000 and can take a credit of $11,650. Since you have maxed the credit, the 2009 expenses will not be eligible for additional credit or deduction.
