Tax Law (Questions About Taxes) - Moving out of state

Expert: Ivan Roth - 7/8/2009

Question
I am moving to Florida permanently, however my NC employer has asked me to work for them remotely for several months.  Should NC state taxes be taken out of my paycheck since I will no longer be a NC resident?  For NC tax return purposes, would I be considered a non resident or a part time resident.  I felt I fell under both categories.

Answer
Hi Angela if you spent more than 183(it seems you are very close) days in NC you would be considered a NC resident and all your income would be subject to NC taxes else you would file as a NC non-resident and would allocate income to both states so in effect you would  not subject income earned in FL to NC taxes
