Tax Law (Questions About Taxes) - claiming my daughter and unemployed

Expert: Alexandra Shainskaya, CPA - 9/8/2009

Question
I'm currently unemployed and i have a 3 month old daughter, i will like to claim her in my next taxes, Do i need to get a job? or should I make her dad claim her?

thanks

Answer
Dear Katherine,

I'm sorry, but I cannot advise you as to whether you should obtain employment or not.  As to who would benefit most from the deduction, you or the child's father, that is a question to be analyzed on a case by case basis.  To make the determination, you can try drafting both your tax returns and seeing which way yields the best results.

Best regards,
