Tax Law (Questions About Taxes)/perdiem and taxes


My husband is on a long term job that he receives taxable perdiem for. The rate is much less then the Federal government rate, can we claim the difference in our taxes? I believe we cannot claim anything going back and forth to our tax home, is this also correct? Shelley


Thanks for your question.

You state that your husband is on a long term job. If the job lasts or is expected to last more than a
12 months, the per diem amount is taxable income and you cannot deduct any travel expenses or per diem amounts.

If is is under 12 months,you can deduct actual expenses for lodging,mileage for travel, and sctual or per diem for meals. Trips home would be deductible. Deductions would be miscellaneous itemized deductions.
