Question I have a question and it's been bugging me. I live in Fargo, North Dakota. I'm 18 and i'm dating a 16 year old. His b-day is April 11, 1991 and mine is Dec 4, 1988. Last year he was 15 and I was 17, I got pregnant in October, two months before I turned 18, he turned 16 in April. Now we have a baby together and he's graduating early this year. We want to move in together this May, but I will be 19 and he will be 17. Can I get in big trouble?
Answer Hi,
Without checking up the exact laws, my theory is that you could be charged with raping someone because her age was 15. I recommend speaking to a lawyer in your area. I'm not a lawyer and cannot give legal advice. Understand online lawyers do not replace off line lawyers. I would recommend Paul in legal ethics on this site, yet he's not a lawyer in your area and can not give legal advice.
So sorry you need to speak to a lawyer in your state. Just an FYI--- You should both talk to a doctor about sex risks and get tested.
Please ask follow ups
P.S. I'm not speaking of the dating law policies for I don't know your state(yes could be a problem), I'm talking about the raping law factor. Did you have sex with him when he was 15? If the answer is yes, than you could be in trouble. If you had sex with him when he was 16, depending on your state laws, you could also be in trouble. 17? yes, some states don't allow this either. I can check your state laws if you want, yet it will take a few days if lucky. Please ask follow ups
One other thing I should add, sometimes the rape laws exclude women raping men and your case the question is would this be it? They however can charge you with other things instead if it does not have the rape charge at hand. I'm not sure of your state laws. I don't replace a lawyer and any information I give you won't be legal advice
