This totally depends on the location, and not being a lawyer I can't really answer this with a legal answer. So note my advice does not replace a lawyers advice.
The general rule is that is illegal and the person could get in BIG trouble for this.
Dating at age 13 in it self could be illegal.
But, lets talk about sex. Sex is something you shouldn't rush into. There are many risks and if someone at age 13 is having sex, they are putting them selves in great danger. I know. I had a friend who had a child at age 15. Homeless now.
My advice is speak to a doctor about sex risks, and get tested. My advice is also stop having intercourse. And if anyone raped you, and that's what that is(in my mind), report this if allowed.
Talk to your parents also and a trusted teacher.
