Finally, what we are doing has never been done before. Question Ok so on May 4th, my family decided to go to Cabo, Mexico and got forced into buying a timeshare. At the time we were just having fun and so we thought "it might be a good investment." At times we were saying no but they kept pressuring us to buy it, even brining up a sales manager to seal the deal. So after we get back home, reality began to set in and we began to witness a whole new world of pain thanks to these people. Anyways, the first few months we paid in time but we got into a crisis and had to consider that our priorities should come up first. So the next week, I called them to cancel but they said that it was too late to cancel and had to pay the timeshare. For months, we dreaded the calls we got from them so I decided to call them to finally deal with it. I explained to them about my family's situation but they just told us we are basically out of luck. So I told her what are my options but she said my only option was to pay the timeshare. Then I told her to let me talk to the sales manager, which said the same thing. After that, I asked her if I could transfer the timeshare over to someone but she said I could not do that. But then she gave me another option, to pay or default. Out of frustration, I told her to default. So now I do not know if I did the right thing or not. My mindset is to help provide for my family and frankly, a timeshare is something that we all agreed is expendable. I know by defaulting, I put my credit in jeopardy but I feel that it was the only thing that I could do. So I have a few questions:
1) Did I do the right thing by defaulting?
2) What are the consequences if I default?
3) I had a co-signer, will thier credit be affected too?
4) Let's say I owe 10,000 in balance, if I default, do I have to pay the full 10,000 still?
5) If I default, does that mean I do not have to deal with the timeshare anymore?

Thank you so much for writing to me on an issue that is deeply passionate to me. The bottom line is that the timeshare business has gone to hell and we are taking back control.
In your letter you failed to mention the name of the company that you dealt with, but I can tell you from experience as early as last week that they know who we are and know that when we call that the world is listening.
This is a site called The Timeshare Chronicles. I set it up to keep my clients aware of what is going on in the timeshare industry.
If you go there you will notice that there is a letter that has been posted in full where Randy Richards, The Associate General Counsel for Consolidated Resorts wrote that he agreed to refund my client in FULL all monies paid. You can also read the situation that he was in that is very similar to yours.
Next, I want you to go to the site that started it all, and that is my personal experience with Ken Molinaro and his Playa Del Sol Resort Chain in Mexico. This will blow you away:
Now, the basic issues that you raise are the same kind of bullshit that I hear on a daily basis. But let me answer your questions one by one!
1) Did I do the right thing by defaulting?
ABSOLUTELY! THIS DEAL IS A COMPLETE SCAM. NEVER PAY ON A TIMESHARE UNDER THREAT OR COERSION. THERE IS A COMPANY IN MEXICO THAT DEALS WITH THIS KIND OF PROBLEM.
2) What are the consequences if I default?
THEY CAN TRY AND COLLECT AGAINST YOU AND THEY CAN EVEN TRY TO PUT IT ON YOUR CREDIT REPORT BUT REMEMBER, THIS IS A DISPUTED DEBT AND WE WILL NAIL THEM TO THE CROSS IF THEY TOUCH YOUR CREDIT, JUST WATCH:
5) If I default, does that mean I do not have to deal with the timeshare anymore?
IT MEANS THAT YOU HAVE DECIDED TO TAKE THIS SITUATION INTO YOUR OWN HANDS AND TELL THEM TO GO TO HELL. IF YOU WANT TO SEE THEM RUN JUST GOOGLE "KEVIN KIM" IN HAWAII, ONE OF MY VIP CLIENTS!
The bottom line is that the timeshare industry is in a tailspin. We are pushing for reform on a worldwide basis and getting results.
DO NOT PAY THESE ASSHOLES!
