About Kate Morgan
Expertise
I can answer questions about cancellation of a timeshare or vacation ownership whether it is a recent purchase or a purchase that is 20 years old. I can offer assistance regardless of where you live or where you purchased, including Mexico. Regardless of whether or not your are paid in full or still making payments I am able to assist you in getting out of your timeshare. I cannot answer questions in regard to resale or rental income.

Experience
I currently work for The Owners' Advocate, a consumer rights advocacy group representing timeshare owners who have encountered fraud or misrepresentation, or simply want to be out of a timeshare that is paid in full. Previously I worked in the timeshare industry for several years as a Quality Control Manager. As a QCM I reviewed the paperwork with clients and answered any questions at the time of sale. In addition, I assisted clients with issues, questions, or cancellations that arose after the purchase.

Education/Credentials
I have a Timeshare License and previously held a Real Estate License. I also worked for a Title Company as a Closing Coordinator.

Time-Shares - Misled on right to cancel my timeshare purchase

Question
Hi,

I've recently come back from my honeymoon in Mexico.  While we were there we ended up having the timeshare hard sell at the Occidental Allegro, Playa Del Carmen. We ended up purchasing what they termed a resale and stated that if we bought it there was no cooling off/cancellation period as it was resale.  They even got us to sign a waiver form stating the same.  I regretted the whole purchase pretty much straight after and, after doing some reseach on the web, found that they have used this "waiver" technique on others.  Once I got back to the UK I reread the contract again and noted that we were entitled to the standard 5 day cancellation period (which has now passed - we purchased on 15th of October). I also noticed that the only thing missing from all the documentation was the waiver we signed, which I'm sure they've destroyed by now. I paid 50% up front on my credit card and signed an agreement to pay 24 installments for the rest, again on my card.  What are my options to cancel or to try and limit my losses?

Answer
Hi Mike,

It is possible to get out of a timeshare contract even though you are outside of the right of rescission.  It is illegal for Occidental to have you sign off on your right to cancel the purchase.

The Owners' Advocate is familiar with timeshare contracts and has a proven track record of getting these contracts cancelled.  We specialize in assisting timeshare owners who feel they have been a victim of fraud at the time of purchase or since discovering what they purchased is not the same as what was presented at the time of sale.  If you would like to explore this option, please contact me.

Kind Regards,
