Question
QUESTION: Last year I was scooped to buy a time share in TahitiVillage Phase II. After sales pitch and false promises they got me to sign a contract and told me that if at any point of time, I'll make more money than I paid. Value of a time share increases 20% every year and that i'll get six free trips to somewhere. They also told me that they are so prompt that any letter I write to them will be answered using FedEx.
But 12 months later I fid this all a freaky dream. i wanted to sell time share and nobody wants to buy it because of Bankrupt owners, increasing annual fees (they increased maintenance charges by more than $100 this year. All the free vacations and getaways were a hoax. I feel so cheated and let down. I can not concentrate on my studies, every two hours they call my home phone and office phone and tell everybody that I own a timeshare and that I owe them money. This is a ridiculous situation and they have not even replied any of my mails, have written them in last 10 months.
I don't know what to do. Please advise

The best advice i can give you would of course to stop paying your monthly dues, because when you do this you are agreeing to a contract with terms that were misleading. Because the company is filing for bankruptcy, unfortunately the chances of you being able to cancel your contract or recouping any money spent are very minimal. Your best option would be to stop paying anything so that you can prove that you dont agree with the terms of the contract.

QUESTION: Thank you Sean. They are calling my home and school and threatening with legal action and report to credit agencies. I send them a letter telling that they fraudulently sold me this time share and I didn't get any response from them yet. I am little scared that if they sue me or report credit agencies it might negatively affect my prospectus of getting a good job or buy a new house in future.
Please advise.

The only thing I could suggest you do is to get in touch with the Better Business Bureau, the Real Estate Commission, and the Attorney general. Make it clear to them that you have been mislead into this contract and that the company has now gone bankrupt and are trying to force you into paying. This is probably your only option and I apologize for your situation I hope this helps.
