Time-Shares - Cancelling timeshare contract

Expert: Andreas Rossler - 10/1/2007

Question
I purchased a timeshare on 9/22 in Hawaii and then changed my mind.  Unfortunately I only had until 9/29 to cancel so we mailed the cancellation letter to the P.O. Box address.  It just said cancellation notice must be received before midnight 9/29.  Do you think that as long as it was post marked by that date it will be good?  I live in CA and the P.O. Box is in Nevada, so they definitely would not receive it until a few days later.

Answer
If you purchased in Hawaii, then Hawaiian Cancellation periods apply.  For Hawaii it is seven days - your cancellation must be post marked within those seven days.  It doesn't matter if they received it on the 10th (or 9th, or 12th, etc.) day after purchase - so long as the post mark is within the seven days.  Once they receive it, they must refund all your money within 15 days.

The only issue - did you send it to the correct address to cancel?  Double check.  Otherwise you are safe.  Good luck!
