Question Hi, my husband paid $13,000 cash for a timeshare on 11/3. That same night we decided to cancel. We drafted a letter on 11/4 and it will be sent via FedEx overnight to the address on the cancellation page of our documents. They should receive it on 11/6. We had 6 days to cancel. Is it ok that we sent the package via FedEx and not certified U.S. mail? Also, do you think they will try to give us a hard time, or should they just provide the refund, as requested? Is there a time limit in which we can expect to be refunded? Thanks.
Answer Sending it FedEx should be perfectly fine. By the way, the cancellation is effective as of the date sent - not when they receive it (so you just had to be sure you sent it within six days and have proof you sent it).
I don't know what state you signed the purchase agreement in, but almost all states have time frames within which the developer must give you a refund. Rarely do those exceed 15 days. I would give them a max of two weeks. However, prudence dictates that you call them and get some verbal assurance that they received your cancellation notice - ask them how soon you can expect a refund. Also, when you are dealing with anyone on the phone, first ask for their name - write it down, write down the date and time you called - that information is extremely helpful should some unforeseen issue arise.
