Question Hi, Andreas,
I purchase time share from Westgate REsorts in Orlando, Florida, in December 2006. It was wrong decision, my husband
passed away, I took my daugther to Orlando to take a stress
away and made a mistake.I din't pay them anything, since December 2006, they called few times, I tried to explain, I can't pay anything(hoping they will foreclouse), but Timeshare people saying I should purchase something smaller.
I have other credit problems - credit cards debts, so my
credit is very bad.Some collection agencies for credit cards. used lawyer, 2 cards send me court papers and trying to garnish my salary. I am concerned about time share, if
they can take me to court and put a garnishment on my
salary. Is it possible? I just received another call from
them today, they said they are trying to help me to purchase smaller unit, and I explained, I can't pay them
anything, so they hang up.

I feel for your situation. I am going to offer some advice, which hopefully eases some of your worries. First, forget about the company - they really don't care about your situation. I absolutely understand how this happened, I too made some horrible financial decisions after my father passed away.
Since there is no concerns about how this will affect your credit, pay no attention to their calls - simply ignore them. The will not garnish your wages, but they will foreclose on the timeshare and take it back.
Unfortunately, in the United States there are some very horrible companies out there that buy bad debts from other companies and then try to collect on those debts. You may have this happen with the maintenance fee portion of your obligation (the timeshare loan and the maintenance fees are two separate obligations). However, I would just ignore them, they will eventually go away.
Of course, I am not a lawyer, so this advice may not end up being absolutely correct - every company handles these situations differently - however, from speaking to numerous individuals who have been through this same experience - that is generally how it turns out with timeshare.
The collections and phone calls can get ugly - but you already know that. If I were you, I just wouldn't worry about the timeshare problem. By the way, the loan is backed by the timeshare - so they cannot go to court and force you to pay, they can only take the timeshare back. However, they don't need to go to court to do so - so that is why things go the way they do. Now they may threaten to go - but in the end, they most likely will not.
