Question
my friend and i just signed the papers for a timeshare in las vegas.  we have arrived home and decided we made a mistake.  we signed the contract on 9/19 and today is the 9/21.  we are very sure we want to cancel.  we signed for the resort that is to be finished in 2011.  we just want our down payment (patial was paid on 9/19 and the balance will be drafted out of my account on 10/20.  we just want to walk away.

Answer
You shouldn't have a problem, but act quickly.  On the front cover of the Public Report or Disclosure Statement that you received when you purchased will be a form explaining exactly how to cancel.  I would FAX the cancellation to the headquarters and sales office and then definitely send it via Certified Mail, Return Receipt Requested.  I am not a lawyer, so verify everything for yourself - however, I think the law is pretty much as follows (yes, you will get all your money back):

“The purchaser of a timeshare may cancel, by written notice, the contract
of sale until midnight of the fifth calendar day after the date of execution
of the contract.”
“ The right of cancellation may not be waived. Any attempt by the
developer to obtain such a waiver results in a contract which is voidable
by the purchaser.”
“The notice of cancellation may be delivered personally to the developer
or sent by certified mail or telegraph to the business address of the
developer.”
“The developer shall, within 15 days after receipt of the notice of
cancellation, return all payments made by the purchaser.”
