Expert: Richard Date: 7/10/2008 Subject: "Buy the Condo; Buy the Parking Space"
Question Could you please tell me the code for CA regarding the police of when you purchase a condo, you also purchase the parking spot/garage associated with that Condo. We are having issues with the Condo Board charging home owners to park in their own parking spaces. Thanks a bunch!!
Answer I would have a real hard time finding the "POLICY" where the Condo association would be either breaking the law or following the law on this subject...
But remember that you are buying "PROPERTY" (IE GROUND) and since the condo and the parking space are 2 different physical spaces I can see where they would do this...
Or are these for "additional spaces" since most people have multiple vehicles now.
Does the Condo come with a Garage attached or what is the arrangement. That might be the key in this argument.
Good luck but its a bit out of my expertise area. Did you have a lawyer look at the "purchase agreement" If so have them check this issue out.
