I've experienced similar oders when the battery was getting over charged and just about out of water. Problem was corrected with a new voltage regulator and battery. This didn't happen to me in my toyota however.

I would say get a good lawyer.  The rotten egg smell is exhaust coming out of the manifold pipe that is attached to your engine and connects to the run that has the catalytic converter inline.  At certain points the two pipes flex because they are joined together by a flange and springs and from time to time through expansion and contraction, it emits raw exhaust.  Also, there is a drain tube for your air conditioning condenser that is run right down by these pipes that leak.  when you turn on the air or fan, and the manifold and exhaust run is leaking, you get that smell.  Fresh exhaust in the cabin of your car.

 Toyota will deny this, but it's the real problem.  I know, because I almost sued Toyota for this same reason.  A Brand new car out of the gate should not give an odor when you are driving and the A/C or fan is running.
