Question We are trying to get our company up and running again. My brother in law has a truck with taga and IFTA already, can he run under our company name on his tags and IFTA authority? Our DOT # is good and we are going to get the MC reinstated. Help of any kind would be greatly appreciated!!!
Answer Melissa, short answer yes.
He will be essentially operating as an Owner Operator under your operating authority. To keep it legal you need an independent contractor contract between your company and any Owner Operator including relatives. Also be aware that any accidents or violations by an Owner Operator will be reflected on your DOT number and you could get sued if he has an accident under your authority. It's a common business arrangement but just wanted to make you aware.
