Subject: Fathers Estate
Question My father died 9/10/2001 and had no will. I have two brothers and 1 sister, and we all signed some paperwork years ago appointing my sister legal rights to access his bank accounts and stocks. My understanding is that the total value is less than 40,000. To date, my sister has stated she has not accessed this money or stocks yet, and repeatedly says she will send me the paper work to take care of it. I believe she has already taken the money, I know the bank and stock account #'s, but without my brothers and sisters cooperation, how will i know if she already got the money out?
Answer You will need to retain an attorney if your sister does not comply. She has had more than enough time to produce the documents, so I suspect you are correct. The only issue is whether or not you can force her to payback what she may have stolen. You need an attorney. Talking to her directly will not help, and you are going to need to get court orders to obtain information about the accounts.
