Question My father passed away 3weeks ago and we didn't get a chance for him to sign a will. The only person that could be executor is myself, I have a brother but he is in jail and will be for the next few years. The only thing my father owned was his townhome. Does this matter need to go through probate?
Answer Depending upon what state you live in you may be able to resolve this through an affidavit of heirship. This is simply a properly prepared affidavit that allows for the sale of real property by acknowledging the possible heirs.
