Trusts & Estates Law - for a friend

Expert: David Disraeli - 11/5/2009

Question
I have a friend in Prison. His father has recently pasted. He knows there was an estate and received a check. He wants to know more about the estate but his brothers and sisters want comply. He feels as though they have sighed his name. How or who could he write to get this information?   Thanks

Answer
Hi Jerome,

I appreciate you looking out for your friend.  If everything was probated through a will that is public record.  Check the county where he died.  If there were IRA's insurance policies or trusts you may never know.  I would get a lawyer if you think it could be substantial.  His siblings should provide him with anything he asks for.  Although I see this all the time it is not acceptable.  A judge can force them to provide the necessary documents to make sure he got his share.

Many attorneys will talk to him for free for an hour.  Check the court records.  Could be that it is not worth messing with.

Yours,

David Disraeli, CFP
