UK/Scottish/Welsh Law - vehicle parts warranty obligations

Expert: Bruce Fyfe - 9/29/2009

Question
Good day to you,
I hope you can help me with this one...
Back in April 09 I had my brakes serviced at a main dealership (Chrysler). I own a Chrysler vehicle. They reported that the o/s/f caliper was sticking so in May 09 I had that caliper replaced with a Genuine Chrysler replacement caliper. The replacement caliper failed on me in Aug 09 in South Wales and I had to be recovered back to the dealership. Chrysler UK representatives came and inspected the caliper and took it back for analysis, they have since accepted that the part is covered under "parts warranty" and any subsequential damage also is covered. The car is still in with the dealership as at today 29th September as Chrysler UK cannot source a correctly manufactured new part. All the stock they have is incorrectly manufactured. I have been told by the dealership that it could potentially take between another two to eight weeks to obtain one that is correct. Obviously I have been without a vehicle during this time. Do manufacturers have any obligation to provide me with a replacement vehicle ie a hire car, whilst mine is being repaired?. I have managed so far and the dealership have helped out too by providing a vehicle initially but I cannot continue without a vehicle if it is going to be up to another eight weeks..Can you offer any guidelines to assist me? The car was recovered to the dealership on Aug 24th 2009 and is still there now..

Answer
Gavin

I think you'll struggle and that Chrysler would only admit liability for a courtesy car after a fight, but speak to your local Citizens Advice Bureau and Trading Standards Office and also seek a solicitor's advice (at the CAB or elsewhere).
Practically speaking, I think you'd be as well hiring a car and then fighting for a refund.
Good luck!
