Expert: Eric Frank Date: 3/13/2002 Subject: The Road Vehicle (Construction and Use) Regulations
Question I have been asked by a large Estate whether or not it is legal to carry passengers in a trailer on the road. The DVLC tell me it is, but I have seen an interpretation of the above Regulation and it seems that it is not legal. Do you know?

Answer My interpretation of the law is as follows:
All vehicles that carry passengers on public roads must be constructed OR adapted for that use. This means that they must have proper seating equipped with proper seat belt restraints that are tested to Department of Transport requirements. The vehicles must also comply with lighting, tyre, brake regulations etc etc.
You will also find that your insurance company have views on this subject.
Of course, providing you only use the trailer on the estate, you can pretty much do what you want, but you should also be aware of your personal liability to the passengers should any of them get injured while riding in the trailer.
