Question I married a citizen of the UK this year and plan to immigrate sometime late summer or early fall next year. I am a US citizen but were married in Wales. How far in advance should I file for my visa based on my time frame for the anticipated move? If my spouse has a passport must I have that for my visa paperwork or will his birth certificate suffice?
Answer Hi Virginia,
I have to tell you that once a visa is issued it is valid for arrival in the UK for up to six months after that date.
Thus if you are coming in summer( June) you can get your visa as early as January.
I would be inclined to apply in about March as then you will have ample time for the visa to be issued and once it is issued you still have six months to fix an exact date to arrive.
I have added a copy of the relevant part of the Rules for you. I believe a copy of your partners passport and the original of his birth cert will be ample to show his nationality. To settle items iv &v you will need to show that your husband has accomodation for you to live in, copy of motgage agreement, copy of rent agreement, letter from parents that you will live with them etc. You will also need to show some proof of his salary and finances. Wage slips ,letter from employee, copy of recent bank statements.

281. The requirements to be met by a person seeking leave to enter the United Kingdom with a view
to settlement as the spouse of a person present and settled in the United Kingdom or who is on the same occasion being admitted for settlement are that:
(i) the applicant is married to a person present and settled in the United Kingdom or who is on the same occasion being admitted for settlement; and
(ii) the parties to the marriage have met; and
(iii) each of the parties intends to live permanently with the other as his or her spouse and the
marriage is subsisting; and
(iv) there will be adequate accommodation for the parties and any dependants without recourse to public funds in accommodation which they own or occupy exclusively; and
(v) the parties will be able to maintain themselves and any dependants adequately without recourse
to public funds
