Question I have been living in the uk for the past 7 years with my mother who is a uk national. I was 18+ when i came to the uk and was given 6 months on arrival. At the end of this six month I applied for permanent leave to remain as a dependent of my mother and was rejected because I was not living in the most unsuitable circumstances. This decision was appealed but was also rejected. I have since decided to apply for a student visa on the advise of my solicitor, due the fact that I am currently on a pre university course and would hate to interupt my studies to go back home. I would like to know what my chances are of this being succesful and what are the neccessary steps in accomplishing this.
Answer Hi Paula,
It sounds to me as if you are an overstayer. You say you were refused an extension and then an appeal.I take it that you were then told to leave but did not do so. My opinion is that you will have difficulty obtaining permission to stay as a student at this stage.
Your solicitor may know an angle but I would not see one at this time.
