Expert: Shane Date: 4/11/2008 Subject: stolen check which were fraudulentley signed and cashed at my bank
Question I had come to realize when I started going through my old personal checking account statments that back in the beginning of Oct 2007 my sons father had cashed 3 of my checks from my personal checking account totalling 400.00. Back at this time, I was not only extremely ill but also one of my close family members was diagnosed with terminal cancer and passed away just recently. My son's father past away Feb 1st and toxicology is still yet to determine the reason for death. I went to Sovereign Bank explained this situation. They were able to print copies of the checks and it was EXTREMELY obvious these were forged. The bank had me sign an affidavid and told me I now need to file a police report against a man who is no longer alive. I called the local police. This report will sit in a pile until who knows when and then they will inspect the case. In the meantime, the nice customer service person told me they cannot proceed w/o copy of me filing report with police. After this, the info will be sent to who knows who and THEN they will determine IF they will re-emburse me my funds. What can I do? This just sounds like a lot of paperwork w/out any even a promise of possible positive results. Putting the stolen money asside, this is VERY disturbing to me on MANY levels. 1. I am dealing with 2 deaths within the last 2 months, I am chronically ill and in pain on a daily basis and I have a beautiful 8 year old boy who just lost his father who he adored. It kills me to pursue this, but financilly I am not doing well, (on SSI) and living in subsidized housing (in which I thought I would never be) considered my financially successfull career before leaving due to illness and having my son. I started my career out at a bank when I was just 18 and WHAT HAPPENED TO THE BANKING INDUSTRY!! Granted this was over 20 years ago but if this situation happened then, we would simply compare signatures to the SIGNATURE CARD, which is still required to be filled out when opening an account now, and if the sig's did not match, with the VP or president's approval the bank would take responsibility immediately and you would receive the monies back into you account THAT DAY!!!

In addition, I found out a realty company called realtytrac.com was taking out 50 a month from my account since august. I did report this to the bank but it was just after their so-called 60 day rule, and the csr at that time just said to go ahead a fill out REALTYTRAC's fraud report. Like a person working for this company would claim that her company committed fraud, talk about irony. Would also like some advise on that. They had stolen over $200.00 from me. I do remember viewing a e-mail they sent me, but, I DID NOT authorize or sign up for their web site for a montly fee. My brother is a real estate agent and i get that info for free, how obserd would that be!!!!
I would like my money back asap and want to know how to push some buttons, without harrasing the little people at the bank that are basically just following the regulations of the institution.

Im sorry for the delayed response. It appears that everything is being handled correctly by all legal means. There is a 60 day rule which is actually a federal regulation, it should reiterate this information on the back of your statements. You must file a police report so the bank can proceed with fradulent charges, because if they choose to reimburse you, they are taking a loss by reimbursing you so they will pursue legal action against the parties involved. So the police report is a necessity. The affidavit is a form where you are stating that yes this is fraud. Im not sure who realtytrac is and I havent heard of them ebfore, that does seem like a "scam". Unfortunately these things do take a lot of time sometimes and their really isnt anything that can be done to escalate the situation. Nine times out of ten I see these turn out in the customer's favor. The best advice I can offer is to keep filing the paperwork they request and "stay on top of it" and it will work out.
