Subject: stolen checks
Question My mom just found out that two checks was stolen out of her check book. They was wrote out in the amount totaling $600.00 The bank will not give her her money back although they can clearly see that the signature is not my moms. She is so upset right now & I feel bad because I do not know what to do. She does have an idea about who wrote it & she knows where it was cashed she has a detective on the case but this is going on 3 weeks. what should we do?
Answer The bank MUST refund the checks. However, your mother MUST follow through with the proper procedures. Every bank is a little different but they usually require that a police report is filed since this is a state crime. Once the police report is filed, and the necessary information is obtained from the police regarding case number, etc. the bank should then have your mother file a forged check report and the bank will then investigate the matter and confirm that the checks really were forged. Simply going to the bank and complaining will not work, and it would appear that the bank is being less helpful than they should be.
Now my understanding is that the bank has at most 2 weeks to either resolve the matter in their favor, or refund the money back to your mothers account. This is from the date that she made the official report to the bank.
