Question
I had a custodial account with my son.  He tried to cash his paycheck against it, but was told he needed my signature to withdraw. So, they "offered" him his own account.  He was 16 at the time, I was not aware of the new account.  When he turned 17, they offered him a debit card, he accepted.  Again, I was not aware.  He has since lost his job, and has continued using his debit card, and has accrued hundreds in overdraft fees which I have just become aware of.  He did not understand overdrafts or the fees and expected the bank would not allow the spending when the account was empty.  I am arguing with the bank that he is a minor and cannot be held responsible for the contract terms of the debit card.  I offered to pay his purchases, but not the fees.  They are threatening collections against him and red marks for 7 years on his credit report.  He's unemployed and HE's ONLY 17!!!!!

Answer
the bank cannot hold him responsible for something if he is under 17 especially if it is custodial, however they could whoever the adult is on the acct responsible and put it on the report.   Ill be completely honest with you while you dont agree with the fees, I would see if they could waive some of the and offer to pay maybe half...its very difficult to get them to waive all the fees and unfortunately I have seen it take its toll on people before....but they may meet you half way
