Question
Hello Mr. Jim, my bank has contacted me that they must pay some 2004 cashier's checks to my landlord, my landlord didn't cash them so my bank returned them into my account after a period of time. Now my landlord has wrote my bank requesting the money for uncashed cashier's checks, my bank tells me we should pay in full and now because it is due. I am trying to not pay the money since it has been over 4 years and I'm looking at SOL (statute of limitations). This is in California. I already talked to my bank about SOL but the bank says cashier's checks are exempt from SOL. Please advice. Thank you in advance.

Jorge, CA like other states, has a statute which deals with "stale dated" checks. The statute usually gives the banks the option of paying after that date even when the statute exists. I suggest you contact an attorney should you wish to proceed against the bank Jim
